Job Description

Role – Social Care Worker (Justice Services, Diversion from Prosecution Team)
Location – GCHSCP, 80 Norfolk Street, G5 9EJ
Hours and Shift Pattern – 35 hours, able to work within an 8am - 8pm framework Monday to Friday.
Contract Status – Permanent

Diversion from Prosecution (DfP) is a process by which the Procurator Fiscal (PF) refers an individual to their Local Authority as a means of addressing the underlying causes of alleged offending behaviour. This can be done instead of a commencing court proceeding (or before final decision is taken in relation to court proceedings).

DfP is one of a range of direct measures which are available to the Procurator Fiscal in Scotland. Which measure is used will depend on the facts and circumstances of each case and what prosecutors consider to be in the public interest. 

The aim of DfP is to deliver an effective and prompt intervention which can address the causes of alleged offending behaviour. This approach will promote the public interest of rehabilitation; prevent further offending behaviour; and provide victims of crime and the public with reassurance that any offending behaviour has been addressed.

The benefits of a successful DfP are that it:
•    Provides the individual with an opportunity to obtain support to deal with any issues or needs that may have contributed to the alleged offending behaviour.
•    Provide early intervention to reduce likelihood of further offending behaviour.
•    Provides a swift resolution and reduces contact with the criminal justice system for all involved. 
•    Prevent stigmatisation of the individual, by avoiding a criminal conviction which may impact on life chances.

The Social Care Worker role within the DfP team is responsible for assessing individuals who are referred to the local authority by the Procurator Fiscal. This assessment process will involve gathering information from our electronic case management systems as well as liaising with social work and health staff in other teams and services within Glasgow City Health and Social Care Partnership, as well as colleagues in the 3rd sector. DfP staff will then be expected to interview the individual with a view to assessing their understanding of the referral, their views of the alleged offence and their willingness to be involved in a period of diversion and undertake work to address any identified needs underlying their alleged offending behaviour. 

The Social Care Worker is then responsible for any diversion intervention with the individual. This may include advice and guidance, signposting or referrals into other services (eg addictions or mental health supports) or direct work with the individual to address their underlying needs. 

Membership of the Protection of Vulnerable Groups (PVG) Scheme is essential on taking up appointment. Please note successful candidates for the above role will be required to pay for their PVG Membership.

 

These roles are excepted under Rehabilitation of Offenders Act 1974 (Exclusions and Exceptions) (Scotland) Order 2013 (as amended).
